Fractional Ownership Terms and Conditions for Referrals
For the purpose of this Terms and Conditions any real estate agent or any pople that give us a refferral will be known as “affilliated partner”. And
SAWO Fractional Ownership and Private Residence Clubs or their agents will be known as the “Seller”
A commission/referral of 3% of the selling price will be paid to any affiliated partner who submits his/her, Registration Form according to the guidelines as outlined below and whose client or referral is the successful purchaser of the fractional
ownership property(s). The client must close on the fractional
ownership property(s) and must pay 40% the total contract price for the fractional
ownership property(s). For real estate full ownership property and land purchases the commission will be agreed on writing acording to each specific case prior to the
fractional ownership tour.
No affilliated partner who referrs people to us will be recognized on a client who has previously contacted or has been contacted by, the Seller or their agents.
In order to be entitled to any commission/referral, the affilated partner must:
a) Register through the sawo.com.mx website.
b) Submit the electronic client referral form with complete client contact
information as stated on the real estate tour for investors.
c) Abide by the guidelines outlined herein.
The Affilliated Partner, by submitting the electronic form, certifies, agrees, and acknowledges that:
a) The Afilliated Partner will not claim any exceptions to the procedures outlined in this document unless made in writing and signed by Seller.
b) No oral registration will qualify affilliated partners for commission/referral.
c) The affilliated partner’s commission/referral will be paid only as set forth under these guidelines and only as pertaining to the specific property(s) being shown and will be due at the final closing of the property(s) purchased by the affilliated partner’s client after all consideration is paid in full.
d) The commission/referral will be payable and disbursed only at closing. (No less than 10 business days after….)
e) The Affiliated partner will hold harmless and indemnify Formula M S.A. de C.V., from any and all claims with regard to such commission/referral.
f) The affilliated Partner will not receive a commission/referral without the signature of the client on the
confirmation registration form.
g) The Affilliated Partner cannot receive any commission/referral in conjunction with any other co-realtorage or referral agreement between Formula M S.A de C.V. and realtor.
h) The Affiliated Partner is not a subagent of SAWO and will be representing the buyer client listed above as his/her buyer’s realtor.
The Affilliated Partner’s buyer client, by placing his/her signature below, certifies, agrees, and acknowledges that:
a) Commission/referral shall be paid only to the Affiliated PArtner representing the buyer client as acknowledge in this form.
b) He/she will hold harmless and indemnify Formula M S.A. de C.V., and Seller from any and all representations made by the buyer’s realtor.
c) SAWO is an agent for and represents the Seller in this transaction.
Comission Payment Structure
In order to pay full commission the 40% of the money from the total purchase value should be collected within 60 days from the initial deposit given to book the property.
If the 40% is not cover within the 60 days commissions will be paid as follows:
10% Down Payment Money 25% commission
20% Down Payment Money 50% commission
30% Down Payment Money 75% commission
40% Down Payment Money 100% commission
Commission structure will be paid as follows:
3% commission from the total purchase value for referrals
that purchase a fractional ownership interest with us.
Once that you take the real estate tour for agents, get your information package and your training you can have access to:
4% commission from the total purchase value for touring and giving the information part of the tour. (if you do not referr the client)
7% commission from the total purchase value for giving the information part of the tour and bring your own customer.
12% commission from the total purchase value for refferring the client, give the tour close the client and help your client with the follow up and closing process. If you need any kind of assistance from SAWO personnel we will be more than happy to help you however you will colect only
7% commission.
